"An employee welfare benefit plan that is a MEWA remains subject to state regulation to the extent provided in section 514(b)(6)(A). ERISA preemption applies only to MEWAs which are employee welfare benefit plans. The Multiple Employer Welfare Arrangement Act was introduced to counter what the Congressional drafters termed abuse by the 'operators of bogus 'insurance' trusts.' ...
