I am relatively new attorney (associate) in the EB field and have been asked by a partner to begin drafting a KSOP. Therefore, I'm looking for a model KSOP document. Does anyone have any thoughts on where I might locate one?

Not necessarily. Just looking for resources, that's all. I'm not asking for someone else's finished product -- I've got to do that myself. I've helped draft a number of ESOP & 401(k) docs, and I'm just looking for a launching point on the combination KSOP.

For firms drafting documents, a continuously-updated library of competitor docs resources is critical. Also, when you get new client docs in for update, can pinpoint last amend. if it was based on such a service.

Don't forget other required, written Administrative Policies & Procedures. Adding them as append. to your doc for clients is really a value-added svc. Toss in the separate, but required QDRO P&P & Model Order, i.e.,
for KSOP, include language to help div attorneys adequately treat receivable contributions as of allocation date of a QDRO.

You should be wary of using a model "catch-all" document. Often such models contain unnecesary or inapplicable provisions which may adversely affect the intended operation of the plan.

I strongly agree with hapa123, especially in the case of an ESOP or KSOP. Many "model plan" peddlers don't really understand the unique fiduciary, investment, transaction, allocation, administration, benefit distribution and other special provisions appropriate for an ESOP or KSOP. It's very different from a profit sharing, 401(k) or pension plan. Caveat emptor (is that right?).
