Does anyone know of any procedural guidance regarding plan terminations that occur while there is a Form 5300 pending? Can you substitute a From 5310 in its place?

Question 17i of the Form 5310 asks if any issue is pending with the IRS. I would answer "yes" and attach an explanation that the D letter (Form 5300) request is still in process and refer them to and provide a copy of the acknowledgement letter that the 5300 application received.

I would give the IRS a call at 877-829-5500, explain the situation and see if an agent has been assigned yet to the Form 5300 filing. That way you can give the agent a heads-up that you are converting the filing to Form 5310.
