Full Version: Governmental HRAs subject to ERISA?

I know that HRA's are subject to ERISA. But, are HRA's sponsored by a government subject to ERISA? I'd appreciate any help.

I would answer no, that they are not subject to ERISA, but with a caution. I am not an attorney, I do not work with any govt entities, and I have not seen any announcement or document that makes it subject to ERISA.

Look at ERISA sections 4(b)(1) and 3(32).
