I have an employer looking to start a new plan, effective 4/1/04. They want to exclude union (cba) employees and also want to have all non-union people employed on 4/1/04 to enter the plan immediately. Is this provision permitted in most prototype documents?

We use a Corbel non-standardized prototype adoption agreement and it has a specific provision permitting that the normal age and service requirements shall be waived for eligible employees as of a specific date and that they will enter on that date.

The "eligible employee" part was what I wasn't sure of. I know I can have everyone enter as of a certain date, but I didn't know if that had to apply to all employees, or if you could apply that only to those "eligible" (i.e., non-union) employees. Sounds like at least Corbel will let you do that.
