I need some assistance.

Are prototype plans required to include trust agreement provisions?

Any help would be appreciated.

I don't believe they are required but most prototypes include the trust provisions.

How large a plan are you dealing with. Most Bank Trustees will have their own Trust agreement. Many prototype documents are combined plan/trust agreements.

It may go back prior to GUST and EGTRRA, however, I thought I read somewhere that most TRA 86 "MASTER" prototype document were designed to have Trust language included, since Master prototypes could only be sponsored by a bank, insurance company or financial institution. Other "REGIONAL" prototypes may not have been written that way--since they were not sponsored by entities other than banks, insurance companies and financial institutions.
