My sister is a 50 year old, single mother with cerebral palsy. Last week she was notified that her job as a microfische clerk for a county court house will be eliminated due to 'out-sourcing". She will be just 60 days short of 20 years of continuous service. Getting her another job will be challenging considering her the limitations due to her disability. I am very upset but am beginning the process of helping make the right decisions for her situation. Any suggestions?

I know that it is possible in some cases for her to prevail if it can be shown that the termination was related to an attempt to deny her benefits. I suggest that you search these Forums for prior discussions.

What has her Bargaining Unit said? While she might not be a Unionmember she most likely belongs to a BU affiliated to a union and there should be a Collective Bargaining Agreement that should be applicable to her as a unit member. There also should be no problem if there is a CBU because usually the Union has to sign a Memorandum of Understanding as part of agreeing to this "outsourcing" and terminations involving BU members, both Union and non-Union.

So, I suggest that you find out about the BU, any CBA and MoU, asap.

GBurns is correct but something else to consider, does she have vacation or anyother time that could be taken to extend her employment?

Is your sister a member of a county or statewide Public Employee Retirement System?

Because you posted a question, I was assuming that something special happened at 20 years of continuous service. But you did not really say that. So, is 20 years of continuous service special for some reason? It would not be for any of the plans that I currently work with.
