david rigby Posted April 2, 2003 Posted April 2, 2003 Whether it can be amended to eliminate anything might be governed by the terms of the plan itself. However, such amendment would not violate the 411(d)(6) protection; the only death benefit that is protected is the minimum J&S benefit to a surviving spouse. I'm a retirement actuary. Occasionally, but not all the time, it might be reasonable to interpret my comments as actuarial or consulting advice.
Mike Preston Posted April 2, 2003 Posted April 2, 2003 Start wtih 1.411(d)-4 Q&A1-4(d). Then trace back to 1.411(d)-4 Q&A1-1(a). Then on to 411(d)(6) itself and finally 411(a)(7). There are other things to read, like the full code and regs mentioned, but those are the highlights.
